Terms & Conditions
Part I — Terms & Conditions of Sale
1. About these Terms
These Terms & Conditions apply to purchases made by consumers through www.oootea.co.
By placing an order, you agree to these Terms and to our Shipping & Returns Policy, which forms part of the purchase contract.
Wholesale orders, professional purchases, events, workshops and collaborations may be subject to separate terms agreed directly with ooo.tea.
2. Products
ooo.tea offers tea, tea objects and related products.
Tea is an agricultural product. Its flavour, aroma, colour, leaf appearance and other natural characteristics may vary slightly between harvests and batches. These variations are part of the nature of the product and do not necessarily indicate a defect.
Many of our tea objects are handmade or produced in small batches. Minor differences in shape, dimensions, surface, glaze, colour and firing marks may occur from one piece to another.
We make reasonable efforts to describe and photograph each product accurately. Colours and scale may nevertheless appear differently depending on the screen, lighting or photographic setting. Only the products expressly listed in the product title and description are included in the purchase; other objects appearing in photographs are not included unless stated otherwise.
The main characteristics and any specific care or storage information are provided on the relevant product page or packaging.
3. Placing an order
Products can be selected and added to the shopping cart. Before submitting an order, the customer can review the cart, change quantities, remove products and correct the billing, delivery and contact information entered during checkout.
The available delivery and payment options will be shown before the order is submitted.
By activating the final payment button, the customer places an order with an obligation to pay.
After the order is placed, an automatic email acknowledging receipt will be sent. This acknowledgement does not by itself mean that the order has been accepted.
The purchase contract is concluded when we send confirmation that the order has been accepted or dispatched.
We may decline or cancel an order before dispatch where there is a legitimate reason to do so, including:
a product becoming unavailable;
payment not being authorised;
delivery not being available to the address provided;
an obvious pricing or product-information error;
reasonable grounds to suspect fraud, misuse or an unlawful transaction.
If an order cannot be accepted after payment has been collected, the relevant amount will be refunded using the original payment method.
Orders may be placed in English or Spanish.
Order information is recorded electronically for order processing, customer service, accounting and other legal purposes. The customer receives the relevant order information by email and may request a copy by contacting us.
4. Prices and payment
Prices are displayed in euros and include the taxes applicable to the product and destination, unless clearly stated otherwise.
Shipping charges and any other applicable costs will be shown before the order is submitted.
The payment methods currently available are displayed during checkout. They may vary depending on the customer’s location, device or the payment services enabled at the time of purchase.
Payments are processed by the payment providers available through our checkout. ooo.tea does not store complete payment-card details.
We take reasonable care to ensure that prices and product information are accurate. If we identify an obvious error affecting an order, we will contact the customer before dispatch. The customer may confirm the order at the correct price or cancel it and receive a refund.
Changes to prices will not affect orders that have already been accepted.
5. Availability
All orders are subject to availability.
If a product becomes unavailable after an order has been placed, we will contact the customer. An alternative product will only be supplied with the customer’s agreement. Otherwise, the amount paid for the unavailable product will be refunded.
Products may be withdrawn or updated on the website without prior notice, provided that this does not affect orders already accepted.
6. Shipping, withdrawal and returns
Delivery areas, shipping charges, estimated delivery times, the right of withdrawal, return conditions, return costs, damaged or incorrect products and refunds are explained in our Shipping & Returns Policy.
That policy also contains the specific conditions relevant to sealed tea, opened food products and fragile tea objects.
Nothing in these Terms or in the Shipping & Returns Policy limits the customer’s statutory rights concerning damaged, faulty, incorrect or otherwise non-conforming products.
7. Customer information and delivery
The customer is responsible for providing complete and accurate contact, billing and delivery information.
If an error is discovered after an order has been placed, the customer should contact us as soon as possible. We cannot guarantee that an address or order can be changed once preparation or dispatch has begun.
To the extent permitted by law, the customer may be responsible for reasonable additional costs resulting from an incorrect or incomplete address, an unjustified refusal of delivery, or failure to collect an order after reasonable delivery attempts.
This does not affect the customer’s rights where a delivery problem was caused by us or by a carrier selected by us.
8. Product care and statutory rights
Tea should be stored sealed and protected from heat, moisture, direct light and strong odours. Tea objects should be used and cared for in accordance with the product information provided.
We are not responsible for deterioration or damage caused after delivery by inappropriate storage, improper use, accidental damage or failure to follow the relevant care instructions.
All products remain covered by the statutory conformity rights provided under applicable consumer law. Information about reporting damaged, faulty, incorrect or otherwise non-conforming products is available in our Shipping & Returns Policy.
Information about tea, preparation, ingredients and related subjects is provided for general informational purposes and is not intended as medical or health advice.
9. Liability
Nothing in these Terms excludes or limits any liability or consumer right that cannot legally be excluded or limited.
To the extent permitted by law, ooo.tea is not responsible for loss or damage caused by:
incorrect or incomplete information provided by the customer;
improper storage, handling or use of a product;
use of the website for unlawful or unauthorised purposes;
events genuinely outside our reasonable control.
We are not responsible for indirect or unforeseeable losses that were not a reasonably foreseeable result of our breach.
The online shop is intended primarily for consumers. Where products are used for commercial purposes without separate written terms, we are not responsible for loss of business, revenue, profit, opportunity or other commercial loss, to the extent permitted by law.
If an event outside our reasonable control affects an order, we will take reasonable steps to minimise the impact and contact the customer where necessary. Statutory delivery, cancellation and refund rights remain unaffected.
10. Website use and intellectual property
The website may not be used to place false or fraudulent orders, interfere with its security or operation, introduce harmful software, collect information without authorisation or infringe the rights of ooo.tea or third parties.
Unless otherwise stated, the website’s original text, photographs, graphics, illustrations, design, visual identity and other content belong to ooo.tea or are used with permission from their respective owners.
Website content may not be reproduced, modified, distributed or used commercially without prior permission.
Non-commercial sharing is permitted where ooo.tea and, where relevant, the original creator are clearly credited and the content is not altered in a misleading way.
11. Third-party services and links
The website may use or link to services operated by third parties, including payment providers, delivery providers and external event or editorial platforms.
We are not responsible for the independent content, availability or policies of websites that we do not operate. Use of those websites is subject to their own terms and policies.
This does not exclude our responsibilities as the seller for payment processing, delivery or other parts of the purchase that remain our legal responsibility.
12. Contact, questions and concerns
If you have a question, concern, complaint or suggestion, please contact us through our Contact page or email:
hello@oootea.co
For an issue concerning an order, please include the order number and enough information for us to understand and review the matter.
Postal and telephone contact details are provided in the Legal Notice below. If a separate address must be used for returns, it will be provided in our Shipping & Returns Policy or during the return process.
We will review communications as soon as reasonably possible and handle consumer complaints within the periods required by applicable law.
13. Applicable law
These Terms and purchases made through the website are governed by Spanish law.
Consumers residing in another country retain any mandatory consumer protections that apply under the law of their country of residence.
Any dispute will be submitted to the courts determined by applicable consumer-protection and procedural law. Nothing in these Terms requires a consumer to waive a court or jurisdiction available to them under mandatory law.
14. Changes to these Terms
We may update these Terms to reflect changes to the website, our products, our business or applicable legal requirements.
The version in force when an order is placed will apply to that purchase. Changes will not affect orders already accepted unless required by law.
If any provision is found to be invalid or unenforceable, the remaining provisions will continue to apply.
A failure or delay by either party to exercise a right under these Terms does not mean that the right has been waived.
